Fundraising Media Ltd (trading as Ride2Raise)

 

Terms and Conditions

 

Fundraising Media Ltd is committed to a policy of fair-trading.  Our Terms and Conditions have been written as a result of our responsibilities under English law.

 

1. Your reservation

All bookings are made and accepted subject to the terms set out in these conditions.  We reserve the right to refuse a booking without explanation but will refund any registration fee made.

2. If we change a ride

We plan tour arrangements many months in advance and though it is unlikely we will have to make any changes to confirmed schedule and arrangements, it does happen occassionaly.  Most changes are of a minor nature and we will advise you at the earliest possible date.

If we are forced to cancel, or in any way change, your tour due to war, threat of war, riots, civil commotion, industrial disputes, disaster, terrorist activities, technical or other problems with transportation, alteration of cancellation or scheduled services or other events outside our control, we will not be liable for any modification, cancellation, extension or delay in the arrangement.

3. If we cancel a ride

We reserve the right, in any circumstances, to cancel your ride.  However in no case will we cancel your ride less than 6 weeks before the scheduled departure date, except for the reasons detailed in Conditions (2).  If, due to events beyond our control, we are no longer able to provide the ride booked, we will return to you all monies paid, and any amendment charges.

4. Responsibility

Cycling is a potentially dangerous activity.  All persons participating in the ride do so at their own risk and accept that the organisers and any associated charities cannot be held responsible for personal injury, accident, loss, damage or public liability, and by taking part in such activities acknowledge and assume the risks inherent therein save for negligent acts and/or omissions on the part of Fundraising Media Ltd, its employees, agents or suppliers, agency or contract of supply, so far as is allowable within the law.

(I) We shall not be responsible nor do we accept liability for death, personal injury or illness caused to you and/or to any named person on the booking form;

(II) You use any transportation arranged by Fundraising Media Limited at your own risk;

(III)  We cannot be held responsible for the condition of any route incorporated in a ride;

 

(IV) Each person who takes part in a ride shall indemnify us against any and all liabilities, claims and costs incurred by or made against us arising out of any act or omission of that person or of the party of which that person is a member; and

(VI) We reserve the right to prohibit any person from taking part in a ride who, in our view, is a danger to himself or to any of the participants on the ride.  In the event that we prevent such a person taking part in any ride pursuant to this sub-clause no refund or compensation whatsoever shall be payable by us.  All persons who participate in a ride are responsible for arranging and paying for appropriate personal insurance cover for the duration of the ride.


5. Customer Service

We aim to ensure that your ride with us is as enjoyable as possible, but if you have a problem during your ride it is important that you advise our representative who will endeavour to put things right quickly.

6. Cancellation by you

If you wish to cancel your booking this must be done in writing by the person and/or company in whose name the booking was made, to Fundraising Media Ltd, Mynster House, Harrow Road East, Dorking, Surrey, RH4 2AU and sent by recorded delivery.  In the event of cancellation or part cancellation the following charges will become payable:

Riders
- Registration fee is non refundable.

 

Cancellation charge (including any deposit paid) as a % total price... 

Between 8 and 12 weeks before departure: 35%.

Between 4 and 8 weeks before departure: 75%



Between 0 and 4 weeks before departure: 90%.

On or after departure: 100%


 

Charities/Companies
- Deposit is non refundable

Cancellation charge (including deposit) as a % of total price...

Between 6 and 12 months before departure: 50%.

Between 3 and 6 months before departure: 75%.

Between 0 and 3 months before departure: 90%.
 
On or after departure: 100%

Cancellations commence from the date written confirmation is received by us.  Please note that if the reason for cancellation falls within the terms of any insurance policy, which you may hold, then the insurance company will normally refund any such charges to you.

7. Your Contract with Fundraising Media Ltd

 

Your contract is made on these terms and conditions, which are governed by English Law, and you agree to admit to the jurisdiction of the English courts.

8. Insurance

We insist that all clients travelling with Fundraising Media Ltd are properly covered from the time of booking with adequate travel insurance which may, if called upon, cover cancellation or curtailment, medical expenses, personal liability, loss of personal effects and luggage, certain benefits in the event of death, loss of limbs, eyes etc.

9. Rider Recruitment and Agreements

Rider recruitment is the responsibility of the organisation or charity (although Ride2Raise will always offer assistance in this). All obligations and responsibilities and agreements are between the rider and the charity or organisation. We would strongly recommend that an official agreement is entered into between the rider and the charity or organisation that includes a minimum fundraising requirement. This agreement should also cover other issues, for example if a rider is unable to compete for any reason. Ride2Raise and Fundraising Media are unable to offer any refunds or price reductions to the charity or organisation if a rider withdraws.

By entering and participating in any Ride2Raise event or training ride you must be aware of and follow our Rules and Regulations. By entering you are confirming that you have read and understood them and that you agree to abide by them.


Rules and Regulations for Ride2Raise events

All riders must be 18 years or over on the start date of the event.

Approved safety cycling helmets must be worn for the full duration of the event and by all riders.

It is up to the rider to familiarize themselves with the event schedule and timings as the event will not be delayed if a rider fails to be in the right places at the right times.

If for reasons of safety or the smooth running of the event you are requested to ride in the Support Vehicle for a time, you must comply. Not doing so could result in disqualification from the event.


Riders will follow group riding etiquette at all times and not endanger themselves or their fellow riders. See our Rider Handbook for more information on this.

Riders must seek medical advice if they are unsure about their fitness or have health concerns. It is the responsibility of the rider that they are fit at the start of the event or training ride.
Riders must inform the Ride Managers or Support Team if they feel unwell.


Only road or hybrid bikes are permitted for Ride2Raise events. Bikes must be in safe working order for the start of event.

Riders may not deviate from the official route and must obey the local traffic regulations, and traffic officers.

Riders may not use mobile phones MP3 players/Ipods while riding.

Ride2Raise events will take place regardless of bad weather and will only be cancelled, re-routed or stopped for reasons of safety. Entry fees are not refundable, however. 


Entry to the Event is at the discretion of Ride2Raise directors and riders agree to abide by the Bye Laws and Technical Regulations of British Cycling.

WAIVER AND INDEMNITY

Riders hereby acknowledge that they take part in Ride2Raise events, training rides, and all events, functions and activities related to these events entirely at their own risk.

Riders agree for themselves, their executors, administrators, heirs, next-of-kin, successors and assigns to waive release and discharge and shall neither have nor institute any claims whatsoever against Ride2Raise/Fundraising Media and its directors, employees, volunteers, freelancers, trustees and shareholders, local provincial and national governmental authorities, event sponsors, charities, and other involved organisations and their employees, volunteers, agents or contractors to the fullest extent permissible under the Unfair Contract Terms Act 1977 or any other applicable law.

Riders hereby indemnify and hold harmless the organisers, sponsors, charities and their employees, agents, volunteers or contractors from all liability and claims made by other individuals or entities as a result of any of the Rider’s actions during an event.

This waiver and indemnity covers death, disability, personal injury, damage to and loss of property of a participant (including theft of or damage to a bicycle) and is effective whether or not such death, injury, damage or loss may have been caused directly or indirectly or wholly or partly by any act or omission including negligence, of any of the organisers, charities or sponsors and their employees and will bind the heirs, executors and/or trustees of the estate of a rider.

Should liability be found to exist in respect of any one of the organisers, sponsors, or charities for any reason then that liability shall not exist in respect of the other organisers, charities and sponsors unless specific grounds exist for liability on their part.

DECLARATION

I have read and agree to abide by the Terms & Conditions, Rules and Regulations and Rider Handbook for Ride2Raise events which I understand may change from time to time and is on the web site www.rie2raise.co.uk I have read and agree to the terms of the Waiver and Indemnity above.

I understand that Ride2Raise events will involve lengthy strenuous activity and that I need to achieve an appropriate level of fitness in order to participate. Before the start of the ride I’m taking part in, if I have any concerns whatsoever about my physical fitness or health, or any medical conditions that may affect my safe participation, I will consult my Doctor. I certify that I am physically fit and I hereby assume all the risks of participating in the event.
If I experience any pain or discomfort during the Event I will immediately inform the Organiser. I agree to submit to any medical examination diagnosis or treatment administered by a suitably-qualified medic.

Any medical information held by the organisers or charities may be released by the Organiser to such Medics as may be appropriate in the event of illness or an accident on the trip and I hereby consent to such medical treatment as may be deemed advisable and authorise the Organiser to notify my next of kin.

I understand that the Event may be filmed, photographed and recorded and hereby grant permission to the event organizers to use such images and recordings of myself.

I hereby certify that the information provided by me for this Event is true and correct.
